Every seller asks the same three questions, usually in the same order. Here they are with the current position.
How is the gain calculated?
Sale consideration, less the indexed cost of acquisition and improvement, less transfer expenses. Holding period decides whether the gain is long or short term, and long-term treatment is materially better.
Can I avoid paying it?
There are two established routes. Reinvestment in a residential house under section 54, and investment in specified bonds under section 54EC within six months, subject to the statutory cap.
What do people get wrong?
Two things. They forget that improvement costs are indexable, and they do not keep the receipts to prove them — so a genuine cost becomes untaxable relief they cannot claim. And they leave the 54EC window until after the sale closes, by which time part of the six months is gone.
We are advisors, not tax counsel. What we do is make sure the paperwork exists to support whichever position your accountant takes, and that the timing is not lost before anyone thinks about it.
