Section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972 is the single provision that decides whether a purchase here is possible at all. It comes up on nearly every Himachal enquiry we take, and it is almost always understood incorrectly.

The rule

A person who is not an agriculturist of Himachal Pradesh cannot acquire agricultural land in the state without prior permission of the State Government. "Agriculturist" is a defined term, and it is narrower than people assume — owning land elsewhere in India does not make you one here.

The exceptions people rely on

Non-agricultural land. Land already converted, or falling inside a planning area with a non-agricultural classification, sits outside the section. This is why most apartment purchases proceed without a Section 118 question at all.

Permission under section 118(2)(h). The State Government may permit acquisition for a bona fide purpose — a house, an industrial unit, a tourism project. This is the route most of our buyers take.

How long it takes

Realistically, six to fourteen months, and it can be refused. We have had one refusal in the last three years and two files that ran past a year.

The mistake we see most often is a token paid first and the section raised afterwards. By then the buyer has no leverage and often no refund. We establish the position before shortlisting — it is the first question on any Himachal brief, not the last.
